What is the National Association of Criminal Defense Lawyers?
The National Association of Criminal Defense Lawyers is the premier criminal defense lawyer group in America. Founded in 1958, NACDL has thousands of members across the country and regularly advocates for the criminal defense bar to ensure justice and due process for the accused.
NACDL will sometimes take positions on behalf of cases at the U.S. Supreme Court by filing amicus briefs. An amicus brief is a “friend of the court” document that is intended to tell the U.S. Supreme Court that the authoring organization has some interest in the resolution of a particular case.
NACDL takes its role in filing amicus briefs very seriously. NACDL only files them in a select few cases; the vast majority of requests to have NACDL intervene in a case are denied.
Similarly, it is a significant privilege to be chosen to write a brief on behalf of NACDL. This work is done at no cost to the organization and is an honor for a law firm to contribute to continuing NACDL’s mission of seeking justice.

We are still awaiting a decision in that important case. But needless to say, that experience helped demonstrate to the legal community that Zachary Newland and David Boyer are prepared to defend clients at the absolute highest level.

As discussed above, in the Pharms case the Evergreen Attorneys team was selected to lead the briefing on behalf of NACDL as amicus. Along with the incredibly talented Zachary Stern of Oregon, Evergreen Attorneys delivered a full-blown brief in support of the petitioner, Keith Pharms.

Pharms v. US Evergreen Attorneys Brief
We anticipate that the U.S. Solicitor General will file a response to the Pharms petition seeking cert. This makes it much more likely that the U.S. Supreme Court will ultimately take a case up for review.
