What Types of Cases Does Evergreen Attorneys Handle?

Federal Fraud Charges
Federal fraud charges can include wire fraud, bank fraud, healthcare fraud, identity theft and more. Offenses such as wire fraud and healthcare fraud can carry significant penalties including up to 20 years imprisonment and hefty fines. Bank fraud under 18 U.S.C. § 1344 can result in even harsher penalties with a statutory maximum of 30 years imprisonment. There has also been a recent rise in prosecuting federal PPP loan fraud cases.
Often times, the government will also tack on identity theft and money laundering charges when a person is indicted on a federal fraud offense. A conviction for aggravated identity theft requires the court to impose a mandatory minimum 2 year sentence on top of any other sentence imposed. Money laundering, like wire and healthcare fraud, can call for a sentence up to 20 years in federal prison.
Federal Drug Charges
Almost half of all federal cases are drug trafficking charges. Most often, these charges are brought under the federal drug trafficking statute 21 U.S.C. § 841. Penalties for drug trafficking vary depending on the type and amount of drug involved, whether the defendant has prior convictions, and whether another person suffered serious bodily injury or death. These penalties can range from 0 to 20 years, 5 to 40 years, or 10 years to life imprisonment depending on the facts of the case. In the case of an enhanced penalty, the defendant could be looking at a minimum term of 25 years in federal prison.
Federal Firearms Charges
Federal firearm offenses make up a significant amount of federal charges brought in Dallas, Texas. Many of these offenses are found under 18 U.S.C. § 922(g), which makes it a federal felony for certain people to possess any kind of firearm. Typically, these kinds of offenses include possession of a firearm by convicted felons, unlawful drug users, non-citizens, under restraining order, or have a prior misdemeanor conviction for domestic violence. These offenses can be punished by up to 15 years in prison.
Another firearm offense commonly charged in Dallas is possession of a firearm in furtherance of a drug trafficking crime or crime of violence. A conviction under Section 924(c) is a serious offense, requiring at least five years imprisonment (up to life) for each 924(c) count to be served consecutively to any other sentence.
